1. Introduction
These Terms of Use ("Terms") govern access to and use of the ApexTraffic online platform ("Platform", "we", "our"), available to users worldwide. By registering and using the Platform, you ("User", "you") confirm your agreement with these Terms and acknowledge that any operations carried out within the Platform are governed exclusively by them. ApexTraffic operates as an independent market participant and acts as a buyer of traffic, conversions, and other results generated by Users. We independently determine the rates, compensation terms, and payment procedures. The User agrees that ApexTraffic is not a mediator, agent, or employer, and that any relationship between the parties is strictly of a civil-legal nature. The Platform provides Users with tools for registration, selection of available offers, obtaining unique domains and links, tracking statistics, and receiving payments for the results delivered. We reserve the right to update these Terms at any time by posting a new version on the website. Continued use of the Platform after any such changes are published constitutes confirmation of acceptance.
2. Description of services
ApexTraffic provides Users with an online platform to work with various offers and traffic sources. The Platform allows: Selection of offers and verticals. Users can choose offers in popular verticals: nutrition (health, dietary supplements), gambling (casinos, betting), dating (dating sites), cryptocurrency products, sweepstakes, and promotional campaigns. The Platform is not responsible for the quality or content of the offers; the selection and effectiveness remain entirely at the User’s discretion. Domain and link generation. Users are provided with generic domains for working with offers, with the option to add their own domains. Postback settings are also available for accurate conversion tracking and integration with external analytics systems. Tracking and analytics. The Platform provides tools for tracking conversions, traffic statistics, user actions reports, and campaign performance. ApexTraffic independently determines which actions count as valid conversions and which are rejected (e.g., in case of suspected fraud). Payment models and conversion types. The Platform supports a wide range of monetization models: CPA (Cost Per Action) — fixed payment for a target action (registration, subscription, app installation, etc.); RS (Revenue Share) — percentage of the revenue generated from the offer; CPL (Cost Per Lead) — payment for a qualified lead; HYBRID — combination of CPA + RS or CPL + bonuses; SOI (Single Opt-In) — lead is considered valid upon first confirmation; DOI (Double Opt-In) — lead is counted after email/subscription confirmation; PPC (Pay Per Click) — payment for a click; And other specialized models depending on the vertical, including nutrition, gambling, dating, crypto, and sweepstakes. ApexTraffic’s Rights. The Platform reserves the right to independently determine: Available offers and payment rates; Which actions count as valid conversions; The dynamics of payments, commissions, and bonuses; Any changes in campaign structures and available tools. The User agrees that these decisions are final and binding. Appeals and disputes. Users have the right to submit appeals regarding earned payments and conversion results via their personal account or through a Telegram manager. ApexTraffic reviews appeals individually, and the Platform’s decision is final. Future capabilities. The Platform reserves the right to: Expand offer verticals, add new monetization models; Integrate new payment systems, including fiat currencies; Implement advanced analytics and campaign optimization tools; Enhance postback and tracking functionality, while retaining the right to modify working conditions.
3. Registration and access
To use the ApexTraffic Platform, the user must go through the registration process, providing accurate and up-to-date information. Registration is only available to individuals who are 18 years or older, and minors are prohibited from creating accounts. The user confirms that all provided information, including email, passwords, and payment details (e.g., cryptocurrency wallets), is accurate and belongs to them. ApexTraffic reserves the right to verify the accuracy of the provided information, including using email verification, two-factor authentication (2FA), and Telegram manager confirmation. The user is fully responsible for the security and confidentiality of their account credentials. Any activity performed using the user's account is considered valid and attributed to the account owner. In case of password or wallet compromise, ApexTraffic is not responsible for any potential losses, and the user agrees to take all necessary measures to protect their account. Creating multiple accounts by one user is strictly prohibited. Violating this rule may result in the immediate suspension of all related accounts without the possibility of fund recovery. The Platform reserves the right to suspend or restrict access to an account if a violation of rules, suspicion of fraudulent activity, or other actions threatening the integrity of the system are detected. ApexTraffic provides the user with tools to access the platform’s features, including selecting offers, configuring postbacks, generating domains, tracking conversions, and receiving statistics. The user agrees to use these tools solely within the platform's rules and not engage in activities that may disrupt the system or infringe on the rights of other participants. Any use of the platform outside these rules may result in penalties, including the deduction of funds, account suspension, and a ban on further registration. Registration and access to the platform do not create an employment or agency relationship between ApexTraffic and the user. The user is an independent contractor providing the results of their actions, while ApexTraffic independently determines rates, payment terms, and conversion criteria. Any claims regarding minimum income or guaranteed offers are not accepted, and the platform reserves the right to change available offers, rates, and terms at any time without prior user consent.
4. User responsibilities
The user agrees to use the ApexTraffic Platform exclusively in accordance with these Terms and in compliance with the laws of the country in which they operate. By registering and beginning to work, the user confirms that they are an independent contractor and are fully responsible for all actions performed with their account. Each offer available on the system has its own rules and restrictions regarding traffic sources. Allowed and prohibited traffic sources are indicated on the specific offer page, and the user is required to carefully review these conditions before starting work. Using any sources not explicitly permitted by the offer’s rules is considered a violation and may lead to payment refusal, balance deduction, or account suspension. Regardless of the specific offer terms, the following actions are strictly prohibited for all users: using incentivized traffic (including cashback and incentivized registrations without consent), manipulation using bots or automated systems, spamming through any channels, artificially inflating clicks or leads, and other forms of fraudulent activity ("fraud"). Detection of such violations will result in sanctions from the Platform, up to complete balance deduction and permanent account suspension. The user is solely responsible for the accuracy of the provided payment details and the security of their passwords. In case of incorrect payment data, loss of access to wallets, or account compromise, all losses are the user's responsibility. ApexTraffic does not compensate for such losses and is not liable for the security of third-party services and tools used by the user. Creating multiple accounts by one person, transferring or selling account access to third parties is strictly prohibited. All accounts related to such violations will be immediately blocked, with no possibility of recovering funds. If the user utilizes advertising materials (texts, images, videos, etc.), they confirm that such materials do not violate copyright or any other laws. The user is solely responsible for the legality and correctness of the content they post. ApexTraffic only provides offers and technical tools for operation and is not responsible for how users promote the offers.
5. Payment system
ApexTraffic makes payments to Users for conversions and actions performed within the platform. The minimum payout threshold is set at $100, and payments are made weekly on a NET 7 basis, usually on Fridays. The Platform reserves the right to change payment timelines or suspend them in case of suspected fraudulent activity, offer rule violations, or technical issues. Available currencies for payouts include BTC, ETH, USDT (TRC20/ERC20), and USDC (ERC20). Transfer fees depend on the selected network and currency and may change dynamically. To clarify the current fee, the user must contact their personal manager, specifying the amount and currency for the payout. ApexTraffic is not responsible for any potential losses due to the user's choice of incorrect payment details. The user is fully responsible for the accuracy of the provided payment details (wallets, addresses, networks). In case of an error made by the user, ApexTraffic does not compensate for any losses and does not make repeated payments without a request through the manager. All payments are made only for actions recognized by the system as valid. In case of fraud or offer violations, ApexTraffic reserves the right to: Upon the first confirmed violation — deduct 100% of the earned balance; Upon a repeated violation — deduct the balance and permanently block the account. The Platform independently determines the payout amounts for conversions, applies rates and bonuses, and reserves the right to change the terms of payments without prior user consent. The user confirms that they have no right to demand a fixed income, a stable number of offers, or guarantees of minimum payments. All questions and disputes related to payout calculations are resolved through the personal manager or Telegram support channel. ApexTraffic's decision is final, and continued use of the platform after receiving information about payouts constitutes the user’s confirmation of acceptance of the terms.
6. Anti-fraud and sanctions
ApexTraffic uses both internal and external anti-fraud systems to ensure the security of the platform and protect the interests of all participants. Checks can be carried out either automatically or manually by platform staff. The user confirms their agreement that any suspicious activities may be reviewed without prior notice or explanation. In case of a violation of platform rules, suspicion of incentivized traffic, bot usage, spam, or other fraudulent activities, ApexTraffic reserves the right to impose the following sanctions: Upon the first confirmed violation — deduction of 100% of the user’s balance; Upon a repeated violation — deduction of the balance and permanent account suspension. The platform may temporarily freeze access to the user’s account to conduct an investigation into suspicious activity. During such an investigation, any operations and payouts related to the account may be suspended. ApexTraffic's decision after the review is final, but the user always has the right to contact support or their personal manager for clarification and to file an appeal. ApexTraffic reserves the right to implement additional security measures and checks in the future, including identity verification (KYC) or additional details. Any changes or new procedures will be introduced at the platform's discretion, and continued use of the platform after their implementation constitutes the user's agreement to the new rules. The user agrees that ApexTraffic is not liable for any losses incurred as a result of the suspension of operations, account blocking, or fund deductions during the investigation of suspicious activity, provided that these measures are applied in good faith and in accordance with these Terms.
7. Limitations of Liability
The ApexTraffic Platform is provided to users "as is" and "as available." Although ensuring user convenience and security is a priority for the platform, ApexTraffic cannot guarantee complete protection from technical failures, temporary errors, data loss, delays in conversion processing, or other unforeseen circumstances. The user acknowledges that they use the Platform at their own risk and accepts all potential consequences related to its use. ApexTraffic is not responsible for the content, quality, availability, or results of offers. All decisions regarding the selection of offers, traffic sources, and promotion strategies are made by the user independently, and any outcomes, including non-payments from advertisers or low conversion rates, are solely the user's responsibility. The platform is only responsible for its own errors and the proper functioning of the tools provided to the user. ApexTraffic is not responsible for the actions of third parties, including advertisers, external services, payment systems, and other platforms. If an advertiser or third party decides not to make a payment, ApexTraffic is not obliged to compensate for such losses and is not responsible for them. The user agrees that ApexTraffic does not guarantee a minimum income, a certain number of offers, traffic stability, or payouts, and all operations occur at the user's own risk. No claims related to the platform's results, payout delays, technical errors, or actions of third parties will be accepted, except in cases where the damage was caused solely by the platform's fault. ApexTraffic's maximum liability to the user is limited to the amount of the unpaid balance in their account. This provision does not limit the platform's right to apply sanctions for rule violations, deduct funds, or block an account in accordance with the Terms.
8. Account suspension and blocking
ApexTraffic reserves the right to suspend or block a user’s account in case of violations of these Terms, specific offer rules, or suspicious activity. Reasons for account suspension or blocking may include, but are not limited to: fraud, incentivized traffic, conversion manipulation through bots or automated systems, spam, creating multiple accounts by one person, and any other actions threatening the security, integrity, or proper functioning of the platform. In the case of temporary suspension of account access, all operations, accruals, and payouts may be suspended until the investigation is complete. The user agrees to cooperate with ApexTraffic and provide requested data if necessary for the investigation. The platform reserves the right to request identity verification (KYC) or additional documents for verification, including payment details, wallets, and contact information. ApexTraffic's decision to suspend or block an account is final. The user has the right to appeal through support or their personal manager, but the review of the appeal does not guarantee the restoration of access or a refund of funds. In case of confirmed violations of platform rules, ApexTraffic reserves the right to deduct funds from the account in full, including bonuses or balances obtained through suspicious or incorrect activities. The platform is not responsible for any losses incurred by the user due to account suspension, blocking, or funds deduction under these rules. ApexTraffic also reserves the right to modify account suspension and verification procedures, implement additional security measures, and update the Terms at any time. Continued use of the Platform after changes are made constitutes the user’s agreement to the new rules.
9. Appeals and disputes
The user has the right to file appeals and complaints regarding accruals, payouts, account suspensions, or other actions by ApexTraffic through the personal account, Telegram manager, or email (sasaostroverh89@gmail.com ). The platform commits to reviewing appeals in good faith and providing a response within 14 days from the date of receiving the request. ApexTraffic’s decision following the appeal review is final. The user confirms that they agree that the platform has the right to change the decision within the rules and conditions of these Terms without separate notification. In disputed cases, the user may contact support for clarification, but this does not alter the final nature of the platform's decisions. ApexTraffic is not responsible for any losses incurred by the user before or after submitting the appeal, nor does it compensate for actions taken by third parties, including advertisers, payment systems, or external services. The platform is only responsible for its own errors in the operation of the system. Appeals apply to the current platform rules and conditions, including payouts, conversions, and account suspensions. New rule and procedure changes made in the future are also considered binding for the user, and submitting an appeal does not exempt the user from complying with the updated terms. The user agrees that continuing to use the platform after submitting an appeal or after changes are made signifies full agreement with ApexTraffic's decisions and the new rules.
10. Changes to the Terms
ApexTraffic reserves the right to make changes to these Terms of Use at any time, including platform operation rules, payouts, offers, and anti-fraud procedures. Users will be notified of significant changes through their personal account, email, or Telegram channel. However, continued use of the platform after changes are made is considered full acceptance of the updated terms. The platform is not obligated to obtain separate consent from each user to introduce changes. All changes take effect from the moment they are published, unless otherwise stated. The user is responsible for reviewing the current version of the Terms and agrees to comply with all rules in effect on the platform. Any disputes arising in connection with updates to the terms will be considered within the framework of these Terms and the appeal procedures outlined in section 9. Continued use of the platform after changes implies the user’s agreement with the terms and waives any claims regarding their implementation.
11. Applicable Law and Jurisdiction
These Terms are governed by and interpreted in accordance with [Applicable Law]. Any disputes between the user and ApexTraffic shall be resolved in the competent courts of the platform's registration location or in another jurisdictional region specified by the platform. The user agrees that any claims or disputes arising in connection with the use of the platform, including payouts, offers, account suspensions, or changes to the terms, will be considered exclusively within the framework of these Terms and applicable law. Continued use of the platform after disputes arise or changes are made signifies the user's consent to the applicable law and established jurisdiction.
